Probate is the legal process that takes place after someone dies. It includes the validation of the will, determining who will be the executor (now called a personal representative), how the estate will be sold and how the assets will be distributed.
The Personal Representative of the Estate may need a License to Sell from the probate court in order to sell the real estate that is part of the estate. A License to sell is needed if there is no will or the will does not give explicit power to the Personal Representative to sell the real estate. The petition to obtain the License to Sell is submitted to the court once a signed purchase and sale agreement is executed.
The best thing the family can do is hire a good estate attorney if they don't already have one and then hire the right Real Estate Agent. Lastly the family should hire the right Real Estate attorney.
